In order to prove the crime of kidnapping cases, the prosecutor must prove the following three things beyond a reasonable doubt:

  1. The accused person forcibly abducted the alleged victim against his or her will.
  2. The accused person had no lawful authority to do so.
  3. The accused person acted with the intent to hold the alleged victim for ransom or reward or as a shield or hostage.

In order to be kidnapping cases the abduction:

  • must not be slight, inconsequential, or merely incidental to the felony crime;
  • must not be of the kind inherent in the nature of the felony crime; and
  • must have some significance independent of the felony crime in that it makes that crime substantially easier of commission or substantially lessens the risk of detection.
